Kittitas County prosecutors charged Yakima County Prosecutor Jim Hagarty with drunken driving last Thursday in Yakima County District Court.
It has been widely reported that he is scheduled to appear in court on the gross misdemeanor charge on Dec. 12 before a judge visiting from Kittitas County, which agreed to handle the case. Hagarty was arrested by a Washington State trooper on Nov. 15 after a minor rear-end collision at Selah. He provided breath-test samples of 0.106 and 0.109, slightly over the legal limit of 0.08 percent.
The 61-year-old Hagarty has been the Yakima prosecutor for three years. He issued an apology the day after his arrest but has since refused comment.
